52-year-old Englewood Cliffs Man Allegedly the Cause for the Closure of Lemoine Avenue

Local residents were forced to contend with the closure of Lemoine Avenue between Maine and Whiteman Streets on Wednesday, December 12, 2012. The reason for this avenue’s closer was because a 52-year-old Englewood Cliffs man allegedly crashed into a telephone pole late Tuesday night. According to police, the 52 year old male was allegedly driving while intoxicated while heading northbound on Lemoine Avenue around 11:45 PM Tuesday, December 11, 2012. It was then that he drove his 2004 Jeep Wrangler off of the road. This resulted in him crashing into a telephone pole. The accident caused the pole and live wires to fall down. As a result the police were forced to shut down a section of Lemoine Avenue and detour traffic. The driver of the crashed 2004 Jeep was later transported to a local hospital with non-fatal injuries.

Lemoine Avenue was closed until construction crews were able to repair the damage caused by the crash. According to Capt. Keith Bendul the repair work included replacing a pole, bringing up transformers and lines, and re-installing them on the pole. The same Fort Lee Police Department Capt. noted the effort that the Fort Lee Police Department is making to urge motorists not to drink and drive. They are doing this in a campaign called ‘’Drive Sober or Get Pulled Over.’’

If this is the defendant’s first driving under the influence offense, he is facing up to a twelve month loss of his drivers license. If this is the defendant’s second dwi offense, then he could potentially lose his license for up to two years. If this is the defendant’s third or subsequent dwi offense, then he is facing up to a ten year loss of his drivers license and 180 days in the Bergen County Jail. The Law Offices of Jonathan F. Marshall is an experienced Bergen County DWI Defense Firm. If you or someone you know has been arrested and charged with driving while intoxicated we can help.

Arrest of Top Illinois Government Watchdog Proves No One’s Above Getting a DUI in Beverly Hills (Or Anywhere Else)

If you were recently busted for DUI in Beverly Hills, you’re probably hugely embarrassed as well as frightened about serving time in prison, seeing your license suspended, and so forth. WILLIAM-HOLLAND-DUI.jpg

Whether you’re a film producer, celebrity, entertainment executive, or even somebody who works outside of the industry (believe it or not, people like that do exist here in Beverly Hills), you’re vexed. You are not the “type of person” who gets into trouble with the police.

Perhaps your arrest was a fluke. Maybe you had one too many cocktails at an advertiser’s fundraiser on Wilshire and then got behind the wheel when you really shouldn’t have. Then the police stopped you, and the drama began. Or maybe you only had one or two drinks but, for whatever reason, the police pulled you over and you blew a 0.09 BAC on the breathalyzer test–above the limit for Beverly Hills DUI. So now you’re in this awful situation.

Understand this: What happened to you can happen to anybody.

Consider the case of 61-year-old William Holland, the Auditor General for the State of Illinois, who was cited several weeks ago for driving under the influence in the town of Springfield. The arresting officers noted that the Auditor General “had a very strong odor of an alcoholic beverage on his breath,” as well as “red bloodshot glassy eyes.” As regular readers of this blog know, these are classic symptoms of Beverly Hills DUI, as well.

Other common signifiers of potential alcohol use and DUI include:

• Slurred speech;
• Inability to answer officer questions;
• Failure to perform mentally or physically on field sobriety tests (like the finger to the nose test or the count backwards by 3 test;)
• Strange behavior–such as overly aggressive behavior towards officers.

Of course, as we’ve discussed before on this blog, alternative explanations for the “DUI symptoms” can exist.

For instance, if you’re exhausted from a hard day of negotiating with potential ad buyers, you might exhibit signs of fatigue, non-responsiveness, and bloodshot eyes. If you get really nervous in front of police, you might be unable to answer certain questions.

The point is not to suggest that your Beverly Hills DUI arrest wasn’t cut and dry–perhaps it was.

Rather, it’s that you should understand that anyone can make substantial errors behind the wheel. Holland was a powerful and widely respected (by both sides) watchdog–someone the government trusted to ensure and fair behavior. He helped prosecutors impeach and ultimately convict former state governor Rod Blagojevich, who began a 14 year prison sentence last year for a slew of corruption charges.

Salt Lake City DUI Attorney

Every justice court and district court in Utah is a little bit different in how they interpret the rules.  Every judge require things that other judges do not.  For example, the Salt Lake City Justice Court judges require a person convicted of  DUI in Utah to take an additional class called the MADD Impact Panel class.  Justice Courts in Ogden and other parts of the state do not require this class.  Some judges will allow home confinement in lieu of jail.  Some judges will not.  Some judges require two days jail, others will allow 48 hours of community service.  Some judges require a costly evaluation done before sentencing, others will simply sentence the day you enter a plea and give order the required prime for life class.  My office is based in Ogden Utah and I am a Ogden DUI Attorney.  However, I practice all over the state and I take the time, and have 15 years experience, that allows me to know the courts, the judges, and the procedures all around the state in any court.  Many people think they should hire a local attorney to “grease the wheels” or hire an attorney that knows the judge and the prosecutor, rather than hire a lawyer that specializes in DUI Defense.  This can be a terrible mistake.  I had this line of thinking.  The problem was that the local attorney got them the best deal they could, but the local attorney did not see the glaring issue that proved that the client was not guilty.  It was a blood case showing positive for a drug that the client had a prescription for and the client was only pulled over for failing to use a turn signal.  There was no impairment and the client had a prescription for the medicine in her system.  WHY plead to anything when the client was legally driving with a legal prescription in her system.  I want to be clear here, you cannot drive with any prescription in your system if you are impaired by the drug to the degree you cannot drive safely.  You can drive if you are not impaired by your prescription drug.  This is what the local attorney that did not specialize in DUI Defense was missing.
